Terms of Use

These Terms govern your use of Remote Bit LLC's RxNote platform ("Platform"). By using the Platform, you agree to these Terms and our Privacy Policy:
1. Platform Access
- We grant you a limited, non-exclusive right to use the Platform for your internal business purposes.
- You may not: reverse engineer, copy, modify, resell, or build competitive products using our Platform.
- We may modify or terminate the Platform at any time.
2. Accounts
- Each user needs unique Login Credentials (email/password).
- Don't share credentials; you're responsible for all account activity.
- We can disable accounts that violate these Terms.
3. Trial & Subscriptions
- Free trials are for evaluation only.
- Subscriptions auto-renew monthly/annually at current rates.
- Cancel anytime; no refunds for pre-paid periods.
- Email [email protected] to manage subscriptions.
4. Your Data & Privacy
- You own Your Data and Output.
- We own the Platform and de-identified/aggregate data.
- You grant us the license to process Your Data to provide services.
- PHI is handled per our Business Associate Agreement (BAA).

5. Data Retention
- Choose to delete recordings immediately or store for 30 days.
- Upon termination, request data export within 30 days.
6. Prohibited Uses
- Do not use the Platform unlawfully.
- Do not upload content that infringes rights or violates laws.
- Do not create multiple accounts to avoid fees.
- Do not interfere with Platform operations.
- Do not process Part 2 Data (substance abuse records).
7. Disclaimers
- The platform is provided "AS IS" without warranties.
- Not a substitute for professional medical advice.
- We're not liable for your medical decisions.
- Maximum liability: $100 or 3 months' fees.
8. Intellectual Property
- We own all Platform IP and trademarks.
- You retain ownership of Your Data.
- Don't use our trademarks without permission.
9. Indemnification
You will defend us against claims arising from:
- Your breach of these Terms.
- Your misuse of the Platform.
- Your violation of laws or third-party rights.
10. Dispute Resolution
- Binding arbitration through JAMS.
- No class actions.
- California law governs.
- We may seek injunctive relief in court.
11. General
- Must be 18+ to use the Platform.
- We may update these Terms anytime.
- You can't assign these Terms.
- If any provision is invalid, others remain enforceable.
Business Associate Agreement (BAA)
Effective as of account creation
This BAA governs our handling of Protected Health Information (PHI) under HIPAA.
Key Points:
- We'll only use PHI to provide services.
- We maintain HIPAA-compliant security measures.
- We can de-identify data for our use
- Upon termination, we'll return/destroy PHI unless infeasible
- Both parties must comply with HIPAA requirements
